Terms of Service

1. Who these terms are with

These terms are an agreement between you and Pedalsim ("we", "us") for the Pedalsim apps, the website pedalsim.com, app.pedalsim.com and the services behind them (together, "the Service"). By creating an account, signing in or otherwise using the Service you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who can use Pedalsim

You must be at least 16 years old, or have the permission of a parent or guardian who accepts these terms for you. You are responsible for your account and for keeping access to your email address secure, since that is how you sign in.

3. Your health and safety

Indoor cycling is strenuous exercise. Check with a doctor before you start or change a training programme, especially if you have a heart condition, high blood pressure, an injury or any other medical condition, or if you are pregnant. Stop immediately if you feel pain, dizziness, faintness or shortness of breath.

Pedalsim is not a medical device and gives no medical advice. Training plans, target powers, heart-rate zones, FTP estimates, predicted results, speeds and every other number the Service shows are estimates from models and your sensors. They can be wrong. You decide how hard you ride, and you ride at your own risk.

You are responsible for setting up and using your bike, smart trainer, sensors and the space around them safely and as their makers instruct. Pedalsim can control the resistance of a connected trainer; you can stop pedalling or end the ride at any time.

4. Free use and subscriptions

Every account can ride a limited distance free, as described on the pricing page. A subscription unlocks the rest. Subscriptions are billed in advance, monthly or yearly, through our payment provider Stripe, and renew automatically until you cancel.

You can cancel at any time from the app. Cancelling stops the next renewal; you keep the subscription until the end of the period you have paid for, and your rides and routes stay in your account.

If you are a consumer in the EU, the EEA or the UK, you may withdraw from your first subscription within 14 days of paying for it by contacting us. Because the Service starts as soon as you subscribe, we refund the payment minus a proportionate amount for the days before you withdrew. Apart from this and anything else the law requires, payments are not refunded, including for part of a billing period.

We may change prices. A change never applies to a period you have already paid for, and we tell you before it applies to your next renewal, so you can cancel first. A founding-member price is kept for as long as that subscription stays active without a break.

5. Using the Service fairly

You agree not to:

• break the law, or use the Service to harass, threaten or impersonate anyone;
• use offensive or misleading display names, route names or other content;
• tamper with ride data or sensor readings to misrepresent what you rode to other riders;
• try to get around the free allowance, payment or access controls, or share one subscription between people;
• disrupt, overload or attack the Service, or access it by automated means other than the interfaces we provide for that;
• copy, resell or reverse engineer the Service, except where the law allows it.

We may suspend or close an account that breaks these rules. Where it is reasonable to do so, we warn you first and give you a chance to take your data with you.

6. Your content

Your rides, routes, notes and profile remain yours. You give us permission to store, process and show them as needed to run the Service for you: for example, your display name, country, avatar and position are shown to other riders while you ride with others visible, which you can turn off. You can export your rides and delete your account at any time.

7. Other services

Some features use other companies' services, such as Stripe for payments and Strava when you connect it. Their own terms apply to your use of them, and we are not responsible for them. Maps are based on OpenStreetMap data, which may be incomplete or wrong; routes and gradients are for training indoors, not for navigating real roads.

8. Changes and availability

We keep improving Pedalsim, so features can change, and we may stop offering the Service. We aim to keep it running but cannot promise it will always be available, error-free or that data will never be lost, so keep copies of anything important. If we shut the Service down, we will give reasonable notice and refund the unused part of any subscription.

We may update these terms. If a change matters to you, we tell you in the app or by email before it takes effect. Continuing to use the Service after that means you accept the new terms; if you do not, you can cancel and delete your account.

9. Liability

The Service is provided "as is" and "as available". To the fullest extent the law allows, we are not liable for indirect or consequential loss, for loss of data, profit or goodwill, or for injury or damage arising from exercise or from your equipment, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.

Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by our negligence, for fraud, or for gross negligence, and nothing affects your statutory rights as a consumer.

10. Law and disputes

These terms are governed by Swedish law. If you are a consumer living elsewhere in the EU or the EEA, you also keep the protection of the mandatory rules of the country where you live. Please contact us first so we can try to sort out any problem. Disputes go to the Swedish courts, unless the law lets you bring them where you live. Consumers in Sweden can also turn to the National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN).
